Legal Requirements

What are the legal requirements for managing asbestos?

Under the Control of Asbestos Regulations 2012, those responsible for non-domestic premises have a 'duty to manage' asbestos. This includes identifying asbestos-containing materials, assessing their condition, maintaining records, and implementing a management plan. For domestic properties, while there's no specific duty to manage, any work should comply with asbestos regulations.

Do I need an asbestos survey before renovation or demolition?

Yes, if your property was built before 2000, a Refurbishment and Demolition (R&D) asbestos survey is legally required before any renovation or demolition work that might disturb building materials. This survey identifies all asbestos materials that could be affected by the planned work.

Who can legally remove asbestos?

For high-risk materials (like pipe insulation, spray coatings, and insulation boards), only licensed contractors approved by the Health and Safety Executive (HSE) can legally remove them. Some lower-risk materials (like asbestos cement) can be removed by non-licensed contractors with appropriate training.
